Recorded in York Co. SC, dated 6 Feb 1869, probated 26 June 1871
State of South Carolina, York County
In the name of God here I Joseph Whisenant of the Country and State of aforesaid, being now far advanced in age, though of perfect memory and understanding, do now by this my last Will and Testament dispose of all my Earthly substances in the following manner. But first I give my Soul to Jesus Christ, and my body to the Earth, to be buried, after my deceased at the discretion of my Executor hereof to be appointed.
It is my Will that all my just debts and funeral expenses be paid out of my Estate.
As my wife UNITY is now far advanced in life and is physically unable to take charge of a plantation and all it's cares; it is my advice that after my death my Estate should be regularly disposed of and that she live with whichever the children she may chose. And I give and bequeath unto her, my said wife take suitable to one her own age and condition, to the amount of one hundred and fifty dollars per year if necessary.
I give and bequeath to my two daughters Eliza and Unity, each, one cow and calf, bureau and serving (or sewing) table, and twenty-five dollars in money, to make them equal with my other daughters that have already left me.
As my daughter Nazareth Saypaugh, has by my gift, received one hundred dollars mor than my other daughters, it is my Will that each of them Eliza, Acenith, Unity and Barbara be made equal to her - Nazareth, in this respect before and equal division of the Estate takes place.
I give and bequeath to my grandson Joe Robert Dickson, my rifle gun, and my blacksmith tools.
I give and bequeath to my grandson Alfred Whisenant, son of Joseph Whisenant, the access to the use of the spring I now use and this he is to have without molestation, It is my Will that all my other personal, and real be equally divided between my five daughters already untill they recieve three hundred dollars each, above that I have already given them, and then the balance of my Estate to be equally divided among all my children.
I do hereby nominate, constitute and appoint my two sons Henderson Whisenant and J. R. Whisenant, the Executors of this my last Will and Testament.
Signed, sealed and pronounced in the presents of us, this the 6th day of February 1869.
